ATF is not just an enforcement agency. They have statutory authority to promulgate regulations, pursuant to those specific statutory grants of authority. Normal regulations are created by following certain notice and comment procedures. But where the regulation already exists and an exemption has been granted, they can rescind that exemption without having to go through notice and comment.

An analogous example is the DEA. Most people think of law enforcement officers in raid jackets when they see or hear "DEA," but there's a whole regulatory side to that entity as well. DEA regulates the manufacture, storage, transport, and distribution of drugs and their chemical components. They even set production quotas for some drugs. A big part of the current shortage of ADHD meds is the DEA setting production quotas too low.
    Thanks for the explanation

So has anyone seen why they did this?

The ripple effects from this event, to Waco, to the OKC bombing to 9/11 there's an incredible cause and effect that highlights how the alphabet boys screw up not only the US but the world at large.

I understand the concern with smoke bombs that are flammable. I live in Oregon and my state lights on fire every year. That said, banning cold burning smoke bombs or “wire pull paint grenades” is just blatant government overreach.

In paintball, I’ve been in mortal danger stuck in an enclosed space with smoke. Yes they can be dangerous. A lot of things are dangerous. But you can avoid these situations. Anyone can choose not to play in an enclosed space/bunker. Inhaling smoke or taking hits is an easy decision for me, personally.

That's a fair point about players being able to make their own choices regarding risk. I've always been on the side of deregulate as long as consumers are given the ability to easily make an informed decision and the ability to reasonably avoid unnecessary harm.

Word on the street is that some smoke grenade manufacturers have an exemption for this. Enola Gaye smoke is allegedly exempt as long as their products are not tampered with.

That's what this whole thing is about: ATF rescinding some previously granted exemptions.

Let's keep it paintball-related and not delve into ATF hate a.k.a. politics. I'm right there with some of you guys but this isn't the place for it.

Those complaining about this have never been choked out of the walls at EMR... Or dragged out a kid having an asthma attack... Or had to get control of some lunatic who managed to set fire to a field with the amount of smoke he tossed into one area.

            It's gone?

            Good.

But.......mah freeedumbs. How am I supposed to be free if I'm not free to fill a stranger's kid's lungs with a mystery cloud? How are people supposed to reproduce if they can't announce genders by burning down half the state? You do realize that agriculture, writing, and amateur pyrotechnics are basically what separates humans from lesser primates, right?

You're being unreasonable. I bet you're one of the same people who who think fishing with dynamite isn't a natural right too. It's not my problem that people want to swim at that beach - they need to go somewhere else if they don't like my freedom.

I kind of figured something like that was going to happen.

Basically there was no rules for how large/hot/ output there were for consumer grade smoke. Now there is
